Outcome of the August consultation
Our conclusion to the consultation and the final guidance document were published on Wednesday 8 November 2017. Consultation responses were received from three stakeholders, and we have responded to all points raised.
The final guidance summarises the provisions of The Railways Infrastructure (Access Management and Licensing of Railway Undertakings) Regulations (Northern Ireland) 2016 (the NI Regulations) and explains the rights and responsibilities of service providers and railway undertakings with regards to access and charging. It also sets out ORR’s interpretation of key provisions, and the process for submission and consideration of appeals.
We have carefully considered feedback and decided to produce a standalone enforcement policy for the NI Regulations and expect this to be published on our website by the end of 2017.

This was a consultation on draft guidance for the The Railways Infrastructure (Access, Management and Licensing of Railway Undertakings) Regulations (Northern Ireland) 2016 (the NI Regulations) and proposed changes to our existing economic enforcement policy. New guidance and changes to our enforcement policy were required to reflect the NI Regulations and as such primarily affected stakeholders in Northern Ireland and users of the cross-border railway only.
We invited views on both the new guidance and revisions to our enforcement policy.
