Consultation response and conclusions

We received only two responses to this consultation, from Edinburgh Trams and from a private individual working in the engineering consultancy field. We consider the low response rate reflected the extensive engagement we had with the tram sector and other interested parties prior to the consultation, with many potential respondents having already had the opportunity to input to our proposals. Both responses we did receive were supportive of the conclusions of the review, which were subsequently implemented in our Strategic Risk Chapter for Tramways and our supervision strategy for the sector. The engineering consultant's response suggested we go further in more fully aligning tramway safety regulation with railway safety regulation. We have given this careful consideration during the period since the Sandilands accident and it is a proposal we are keeping under regular review.

We have sought the views of tramway dutyholders on ORR’s proposed approach to improving how the safety of Britain’s tramways is regulated and supervised by ORR.

The consultation document provided an outline of our conclusions from a review of the legislative framework for tramway safety, and current thinking on how to strengthen that approach.

This consultation explained and sought the industry’s views on:

  • The consideration ORR has given to each aspect of the framework;
  • The areas where we are not recommending changes, and why; and
  • Our three specific improvement proposals around the use of the Risk Management Maturity Model, the EU Common Safety Method on Risk Assessment and sharing of safety data.
